ok, my friends father USC filed an I-130 on her behalf before April 30 2001.. She was under the category of unmarried daughter of LPR.. The father just recently became an USC..She got married b/c she didnt know she wasnt supposed to and admitted it at her interview and was denied I-485..Laurel says she can use the previous I-130 filed before on April 30th 2001, but send in another I-130 under the category married daughter of USC..
We are trying to find out what the process is..Can she send in I-130 with I-485? Or does she have to send in I-130 and wait for an approval? then if she is approved how will she know when to send in the I-485? When she is approved does that mean that visa number became available? Or how does she know when priority date was reached? I am still confused..When she sends in I-130 does she need to send in previous I-130 also? Or does she show that at the I-485 interview..
It says California is processing I-130's from April 2001 and Vermont from 2006? Is there a way to get hers sent to vermont??
