OK, so I talked to an ICE officer at the jail where my husband is being held. HE FREAKED ME OUT! The officer said that, supposedly, my husband has a "very old" A# which means he has had contact with immigration in the past. I know my husband, and I know he has NEVER entered but one time, and he has NEVER been caught here until he went to prison in July.
His A# starts with a 7, and they are now assigning A#'s that begin with 8. I am very concerned... Just how old IS an A# that starts with 7? Six months old? 3 years old? I am soooooo scared!
Can you guys tell me what digit you or your loved ones' A#'s begin with, so that I can have a comparison? I also need to know about when the A# was assigned.

My A# starts with a 9 and i got it in July of 2006..hope that helps

Just to be clear my A# is an 8 digit number and it starts with a 9

What that means is that the ICE officer is full of crap... Mandee told me her hubby's A# starts with an 8, and he just got it this month. If yours starts with a 9, and you got it in July of 06, it tells me that they don't necessarily give out A#'s in numerical order.

OH NO! they don't give them out in any order and as you said he's full of crap...their only aim is to have him deported so it's useless listen to them.

His Notice to Appear also says that they determined he entered the US on or around April of 2000. Ok, that is SO untrue... he was only 17 in 2000, and was enlisted in the Honduran military. I can PROVE that he wasn't here until February of 2003. They are so retarded!

Unfortunately I don't. I have no money for a lawyer. I am attempting to bond him out myself... I know how to do everything except for request a bond hearing. Is there any hope if I do it myself, or am I wasting my time? Should I tell him to go ahead and sign the deportation papers so that he can go home?

If he came in on a visa i think you have a chance but he will have to represent himself and state that he's got a wife and kids? here and you should be at the bond hearing OR you can call or go to the court and ask them how you go about getting him bonded out without a lawyer.
My husband's and my BIL's A# start with 9. Mine's starts with 4 (back in '97).
He has an NTA scheduled already? When?
Did the ICE officer said he can be bonded out?

Well, the problem is that he is in Georgia, and I am in Kansas City. I just emptied my checking account by sending off his I-130, so I can't fly there. I talked to a law office, and they suggested that I make up a package with letters from family, friends, clergy, etc-- and I have all of that. I am just waiting for my certified mail receipt. I am going to include pictures of our family, just to soften up the judge a little bit. He entered without inspection, unfortunately... no visa at all. I wish I could walk into the court and ask for a bond hearing, but can I do that from Missouri? Like, can I walk into the closest immigration court and request one for him in Atlanta? Also, I need to find out who my husband's judge is, so that I can overnight the package to him.

Have you tried getting advice from Laurel Scott? LauraFern or KitKat can advise you on how best to get ahold of her and even if there is a consultation fee, the advice will be worth it's weight in gold. You certainly want to make sure that you don't make any mistakes now. Are you able to see your husband at all? My heart goes out to you and I wish that you didn't have to go through this.

JMRJ-- the ICE officer I talked to only worked in the holding jail, and said he didn't have my husband's file in front of him. The notice to appear he received does not have a date anywhere on it, unfortunately. I have a feeling there will be a more formail meeting with his assigned officer when he is moved to GA.

Oh-- and also, the ICE officer said he was not elegible for bond... which makes me wonder why he was able to just spout that out, since he told me he didn't have the file or anything.
All I did was give him the A#, and he was looking around in the computer and stuff, and all he could tell me was what the charges were, etc.

He did not have a file # with him so why did he say he has an A7 blah blah blah number. The law office said to make up a package of letter and all of that. Is that for a request of a bond hearing? So, he does not have a court date set yet?

Oh man,ok well what i would suggest is try and get the number for the immigration court that he will have his hearing and call the court maybe give his A# and find out who is gonna be the Judge that he will be seeing and maybe ask for the address of the court and mail it in to him....i gotta go but i hope something works out for you and feel free to ask any questions as i have been through this with immigration court and bond hearing..good luck.

ICE officers will tell you he's no eligible for bond because they wanna deport him,ask Mandee they also told her husband that too and look at the outcome he's home!
If the ICE officer told you he is not eligible for the bond then you need a bond hearing. If the alien has previous immigration violations before, then the ICE may conduct a mandatory detention. You need to dispute that in front of the Judge before he gets deported because the ICE can enter something on their database and that can cause a problem on his visa interview at Honduras. Do you have hard evidence to prove that he was in fact at Honduras the same time of the EWI accusation?

JMRJ- I gave the A# to the officer, so that is how he knew it started with 7. He was like, "Well, first of all, that is a really old A# if it starts with 7. We are issuing A#'s that start with 8 now, so obviously he has a history with immigration. He is not elegible for bond... but I couldn't tell you exactly what's going on, because his file is not here."
Carribeanman- I called the Atlanta Court, and I have left like 3 messages. No one ever calls me back... it's all automated. I can't ever get a human on the phone. :(

Yes-- I can definitely get evidence, but there is no way I can get it in time for his court hearing. It would all be in Honduras, and I'd have to get his family running around to get it for me. Then the mail system there is so slow and unreliable, I wouldn't get it for about a month!
If that's the case, they don't answer their phone, you need to request the bond hearing in writing so you can mail the package as well. What is not clear if how will you address the Motion for Bond Hearing -- will your husband needs to sign it or can you sign it on his behalf since you are not using an attorney.

It is like preparing a hardship packet. You make a brief along with supporting documentations convincing the Judge that he is eligible for the bond and he is not a danger to the society blah blah blah and that if he can be released at the lowest possible bond or at his own recognizance. His freedom is at stake.

I have read your messages and I know exactly what your going through ,,,, my hubby was detained for nearly 5 months ,,,and he has 2 A#'s one which was given to him bckin 1992 through a raid and starts with a #A7 which is really old because he was deported but my hubby was a minor at the time ,,,and he was ordered final deportation ,,, the other is the one he got in 2006 with his auth for employment and his ss# me andmy lawyer try gathering alot of stuff like letters and struff but was useless, hubby just wasted his time there for nothing we did a MTR but was never granted ,, I mean in my opinion I think you should tell hubby togo back to Mex I mean is hard to try to get hubby out ,,,especially if they insist he has a A# which starts with #7 and to them it means he has a record in file ,,, this means he will not be able to get a bond ,,,

Well, it is just impossible for ICE to claim that his A# is as old as 1992... I mean, he was only 11 years old then! I am interested to see what they are charging him with. He has never been deported before, nor has he had any type of immigration hearing. USCIS is just on crack, and I will do anything to PROVE IT!! HA! Thank you for your kind words, Anita. Part of me just wants to let him go back to Honduras so that he is not depressed and alone anymore. The other part of me really wants our daughter to see him for a few months before he has to go back and wait for our waiver. That is why I want to fight so hard for our bond hearing... he hasn't seen his daughter since she was a month old, and Emery-Grace isn't even aware she has a Papi.
The good news is that I found out there is something in the great state of Missouri called the "Immigration Assistance Project." It is through LAWMO, which is like Legal Aid, and immigration cases (as well as domestic abuse cases, etc.) have a higher priority level over other types of cases. Check out the description:

Staff assist individuals and their families with immigration problems including gaining legal status, temporary and permanent resident status, and US citizenship. In addition, the project provides counsel for those facing deportation and seeking work permits. Legal assistance can often help avoid the breakup of families and help immigrants continue to be productive members of their communities. LAWMo offers free representation to immigrants in the entire state of Missouri.

The ICE prison in Georgia is about a 4 hours drive from Atlanta. Air tran has really good deals if you look. I was looking for a ticket to Atlanta when I was going to get my puppy and they were only $65 from Raleigh to Atlanta round trip with taxes. Check them out. I drove my friend from here in NC all the way to the prison in Georgia, Columbus almost to the Alabama line so she could see him for an hour. It's a long haul but well worth it.
You can do everything yourself. Have you thought about legal aid or catholic charities? The good thing is that you already filed the petition so you're one step closer. The bad part is is that if he is going to the prison I'm talking about he's going to have to wait until they have enough to fill up a plane to send him back home. At least that's what they did with my friends boyfriend.
Fight for that bond hearing. You can send them a certified request. They can't ignore or deny that. Just a thought. I would keep trying.

well my husbands A # starts with a 7 also and he was issues that in 1999 so i think they just give numbers out and not in any certain order. i hope u can get a bond hearing. u are in our prayers

If it was me personally, I would not give up! If you have a chance then fight it, I wish I had that opportunity! And just like carribbeanman stated ICE's main objective is to get him out of here! So I bet that they are telling you whatever! And the ICE guy is outta his mind if he says that about the A number. My husband has 2 also, one from 88 which starts with A2 and then one from 2001 when we tried to adjust under 245I that starts with A07. They say to drop the 0 so his is A7. If you have a way of keeping your man here and not Honduras, then do it!! Like i said before when we went for the interview in Tegus the IO stated that so much incorrect info is put in peoples A files and I believe it. It is just the people never question it. If you can start calling family members and start getting that proof together then do it!! Tell his family that this is a matter of life and death! And if you need me to send them the money to Honduras so they can DHL or UPS the proof to you then I will! Never give up!!:thumbup:
