View Full Version : 601 Waiver and 212 application in Haiti--Help

I am new to the forum. I am a liitle lost and need some help. My brother will be deported back to Haiti on Monday(2/25/08). He is and has been married to a US Citizen for almost 3 years but they never file a I-130 because they were advised not to do so since he had a final order of deportation. I know that he will need to file the I130, 601 and the 212, is there a particular order in which they must be filed? Can all of them be sent at the same time or does he needs to wait for the approval of the I-130 before filing the other applications? What is the normal time frame for the whole process? I have heard so many different stories that I am unclear on what to do first.

They will have to file the I-130 first. Once that is approved he will have an interview at the consulate. He will be denied a visa due to the deportation. The consulate will then let him know if he is eligible for a waiver and instruct hime to file the I-212 and I-601. I have no idea on time frames in Haiti, perhaps someone else can help. I would think that you are talking at least a year and probably longer.

Ditto to Shrek. They need to file the I-130 and then since he's been deported and it might speed things up, file the I-129F (yes it's for fiances but it can also be used in conjunction with spouse visas to get faster visa interviews) to get a K-3 interview. As far as Haiti, I don't know that there is anyone going through there from this forum, but you might want to speak to a good waiver attorney like Laurel Scott to assess your chances of being approved for a waiver at that Consulate.
They can't file the waivers until they have had the consular visa interview though. They have to wait until the visa is denied and then file the waiver. The whole process could take more than 2 years, hopefully less!

I am currently going through the same problem. My husband is being detained and awaits to be sent home. I have the same questions as you.I wonder if anyone has ever been approved from Hait and how long the whole process? Please, help.
