View Full Version : Taxes and employment for N400

I would like to file my N-400 as I have been in the US for 10+ years and have been married to a US citizen for 8 of those (divorced now) and have been a LPR for more than 5. I think it is a good time now for me for various reasons.

I owe some taxes from last year and I have repayment plans in place and am paying them on time monthly as per the plan with the IRS. Does this mean I have overdue taxes and need to check the box on the N-400?

I have been working in sales and although I have had high incomes I have job hopped quite a bit to various opportunities. I am currently doing some freelance work and trying to find a different job outside of direct sales. Will not having a current position affect my application?

I did some self employment work last year too, but that was of no concern at the interview.

As far as the taxes go, if you have worked out an agreement with IRS and are sticking to it, I don't think your taxes would be considered overdue. But you may want to check with a lawyer on that to be sure.

Thanks - I think overdue must mean simply not paid and owed - which is of course a bad thing.

Did they ask for verification of self-employment such as 1099 forms or income reports etc?

I brought tax returns for the last five years, because a friend of mine going through the process told me they wanted to see it at his interview. In my case they were not interested in the returns.

In your case I would bring as much evidence as possible, just in case.
