thank God our 601 was approved in athens 7/31/07
we are so happy. now we are waiting for visa pick up date
does anyone here know the next step for filing to go on track for citizenship
i know that he will first be conditional resident as our marriage will be 2 years this january (the website states you must file to remove these conditions 90 days before anniversary and if you delay/forget/or are simply unaware the us can boot him out again... wow) just some information everyone should be aware of.
anyway, is there some sort of idea as to the next set of forms to fill out once he gets the visa pickup....

I believe you have to file form I-751 petition to remove the conditions of residence. Congratulations!!!

Also the GC will be issuesd for 2 years and I believe it is 90 before that expires that you lift the conditions not at your 2 year anniversary....Can someone correct me if I am wrong.

My confussion increases after reading thing.....
'cause, we have been married for 9 years now. So, when our case get approved, I enter the US with what kind of "conditional GC", if any? And what is this "90 days" period before 2nd anniversary thing? I mean to ask, why someone (husband and wife here) would "apply" 4 "removal"? "Removal of what and what 4?
Guess I'm really dumb, but I still take courage to be here knowing that there are folks here who can straighten dumb head like me

Mahmed,

90 days before your 2 yr marriage anniversary you must apply to remove your conditional status. It's nothing bad, you are just removing that status and replacing it with a "permanent resident" status. Like Naf said however, if you forget to apply to remove the status 90 days before your 2 yr marriage anniversary you will be considered illegal and thus ineligible for becoming a permanent resident so don't forget to apply!!
and you are not dumb by any means! this American legal system is just quite complicated .. :)

Hey. I am going through Athens as well. When did you file your waiver? I see you were approved on July 31. How long did you have to wait for your waiver to be approved? Congratulations. You will have to wait for Athens to send your approved file to your embassy. Then your embassy will contact you for an interview where you will probably be given your visa to travel back to the US. After that you will recieve your green card and SS#. After you get your green card, you can file for citizenship. That will take approximately a year before they contact you for an interview and then you will take the test and then they will contact you to go to a courthouse to recieve your American Citizenship. If you have been married two years or more on entry to the US or on approval of an adjustment of status, you are eligible for permanent resident status - a 10 year green card. There is no conditions to remove.

If you have been married less than two years you are granted permanent resident status with conditions - two year green card. The conditions mean that you must then show that you have a marriage not entered into solely for immigration purposes, that you have a bona-fide marriage that has lasted two years after being granted PR status. This is applied for within 90 days of the two year anniversary of the entry to the US when you were granted permanent resident status, or two years from being granted permanent resident status from an approval of the adjustment of status. You will find the date on your PR card. Subtract 90 days, and it is from that date that you to apply to have conditions removed, by filing form I-751.

so, that means that we do not have to apply for rewnoving anything since we have been married for 9 years now, right?
I just wana miss anything throughiut the legal process, since many of us agree that U.S. Immigration Law is not that easy to follow due to individual lack of understanding of the process.
By the way, which form does some one need to apply for that removal thing?

Correct. If married two years or more you should be granted a 10 year green. Which means there are no conditions to be removed. If you were married less than two years and granted a two year green card which is permanent residence with conditions, then one would file the I-751 within the 90 day days prior to the two year anniversary of being granted permanent resident status, to have conditions removed.

If one is entering the US on an visa, one should ensure at entry that they are granted the correct status. Gently remind the IO if you are given 2 years with conditions when it should be 10 years as it is a pain in the butt to correct at a later stage.
